1. INTRODUCTION

1.1 You will be able to access most areas of this Website without registering your details with us. Certain areas of this Website are only open to you if you register.

1.2 We may revise these terms and conditions at any time by updating this posting. You should check this Website from time to time to review the then current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this Website.

2. ORDERING FROM US

2.1 You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.

2.2 Our acceptance of an order takes place when we despatch the order. We will send you a despatch confirmation by email. When we despatch the order the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order.

2.3 Goods can only be signed and accepted by the card holder.

2.4 We may refuse to accept an order:

(a) where goods are not available;

(b) where we cannot obtain authorisation for your payment;

(c) if there has been a pricing or product description error; or

(d) if you do not meet any eligibility criteria set out in our terms and conditions.

3. PRICING

3.1 All prices include VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price.

3.2 Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this Website.

3.3 Our prices are reviewed periodically.

4. CANCELLATION AND RETURNS POLICY

4.1 If you wish to cancel your order:

(a) you can notify us by email to cs@tcrdirect.co.uk before we have dispatched the goods to you; or

(b) where goods have already been dispatched to you, by returning goods to us in accordance with clause 4.2 below.

4.2 You can return goods you have ordered from us for any reason at any time within 7 working days (working days are Monday to Friday excluding weekends and Public Holidays) of receipt for a full refund or exchange. The costs of returning goods to us shall be borne by you. The goods must be returned complete, unused and in 'as new' condition (e.g. if you have opened the box to examine the product you must have done so without damaging or marking the product in any way). It should be returned with the original box, packing and accessories. Pre-recorded material such as videotapes, DVDs, CDs and other software must be sealed. Any 'Free Gifts' received with the product must also be returned. Where goods are to be exchanged, you will be responsible for our delivery costs to you. We will notify you of the likely cost at that time.

4.3 Upon receipt of the goods we will give you either a full refund of the amount paid or a TCR Direct exchange credit voucher as we deem entirely appropriate in the circumstances.

4.4 The rights to return the goods to us as referred to in clause 4.3 will not apply in the following circumstances: -

· in the event that the product has been used

· in the case of software, audio or visual products, where the packaging has been unsealed

· in the event that the product has been tampered with in any way

The provisions of this clause 4.4 do not affect your statutory rights.

5. FAULTS

5.1 If there is a fault with your product within 12 months of delivery (or other defect with your order), we will be happy to offer a repair service or attempt to resolve the fault as best as we are able. Please telephone our faults/aftersales service on 0845 862 0037 (9am to 5pm Monday to Friday & 10am to 5pm Saturdays and Sundays). If a fault occurs while you are abroad, please contact us after you return to the UK. Our repair and fault resolution service does not apply to faults caused by accident, neglect, misuse or normal wear and tear. We reserve the right to make a charge for this service and you will be notified of the cost of doing so prior to us undertaking any repairs or resolving the fault.

5.2 You will also be responsible for our costs in collecting goods for repair or you will be responsible for the cost of delivering the faulty good to us.

6. NO LIABILITY

6.1 No liability is accepted for consumable parts or consumable items such as toner and print cartridges or damage to the products or goods as a result of the installation or use of defective or unsuitable consumables.

6.2 No liability is accepted for any damage to or loss of the products or goods or faults which arise from hardware connected to or inserted inside the goods or products. No liability is accepted for any other loss such as loss of data or consequential loss.

6.3 No liability is accepted for damage to the goods, any fault arising, loss of data or any other consequence arising from the loading of any software into the goods and products.

6.4 In regard to TFT Monitors/ Flat Panel Displays, no liability or responsibility is accepted for dead or defective pixels on these products.

6.5 No liability is accepted, if after placing an order and such order having been completed, the customer identifies that the goods and products are available elsewhere at a lesser price.

7. LICENCE

7.1 You are permitted to print and download extracts from this Website for your own use on the following basis:

(a) no documents or related graphics on this Website are modified in any way;

(b) no graphics on this Website are used separately from accompanying text; and

(c) any of our copyright and trade mark notices and this permission notice appear in all copies.

7.2 Unless otherwise stated, the copyright and other intellectual property rights in all material on this Website (including without limitation photographs and graphical images) are owned by us or our licensors.
